General Terms and Conditions
CANnual Conference 2016
These T&Cs (hereinafter referred to as the T&Cs) set out the general terms and conditions applicable to the registration for and attendance at the Cannual Conference - announced through the websites operated by Café Communications Kft. (hereinafter referred to as Café) under www.cannualreport.hu and www.wecan.net domains (hereinafter referred to as the Website) and the subsequent gala dinner (hereinafter collectively referred to as the Conference), as well as the rights and obligations of persons so registering for the Conference (hereinafter referred to as the Applicant) (Café and Applicant hereinafter collectively referred to as the Parties).
By registering to the Conference, Applicant declares that he understood these T&Cs and accept to be bound by them. Should Applicant refuse to accept these T&Cs, he will not be permitted to register for and attend the Conference.
1. General Information, Conclusion of the Agreement by the Parties

1.2. These T&Cs fully regulate Café’s and the Applicant’s rights and obligations in relation to the registration for the Conference.
1.3. Café declares and Applicant expressly agrees that Parties consider emails as written communication unless paper based written communication between Café and Applicant is required by law or these T&Cs. In view of the above the Parties explicitly record that the basis for the legal relationship between them is the online cooperation (Conference registration through the conclusion of an online contract), so communication between them is based on the correspondence via email.
1.4. Conference registration may be carried out through the Website electronically, as defined by these T&Cs.
1.5. The Parties’ agreement deemed to be concluded upon successful online payment, by Café’s confirmation of registration. The agreement concluded shall not be considered a written agreement, it is not filed, so it will not be available at a later date. The conclusion of agreement may be proved by the registration data saved electronically and the invoice issued which shall be stored by Café for the period specified in accounting and tax laws. The Parties conclude their agreement in Hungarian/English language.
1.6. Applicant shall solely be responsible for the accuracy, up-to-dateness and the truth of the data provided during registration. Café excludes all kinds of liability that may arise from the incorrectness, misstatement and typing error of data provided through the Website. Data relating to the registration submitted may be corrected by writing to Cannual_Conference@cafecommunications.hu email address.
2.1. Applicant may find detailed information about the Conference on the Website. If you need more information than communicated on the Website, please write us an email to Cannual_Conference@cafecommunications.hu e-mail address.
2.2. The Conference participation fee is indicated on the Web page.
2.3. Café reserves the right to change the Conference participation fee. Such change shall take effect simultaneously with the its publication on the Website. Said change does not affect the amount of Conference participation fee negatively if the Applicant has already sent his registration before the change of such participation fee, so the Applicant shall pay the fee in each case that can be seen on the Website at the time of submitting his registration.
2.4. If, despite utmost care shown by Café, an incorrect price is published on the Website, with especial regard to an obviously erroneous price, Café shall not ensure participation at the Conference in consideration for such erroneous price, but it may offer Conference participation for the correct price and based on such price Applicant shall be entitled to withdraw his purchase intention.
2.5. Café shall only accept the registration through the Website if the Applicant filled in all fields in the Registration Form that are necessary for registration. Café shall not be liable in any case for a delay or any other problems or errors that may result from registration data indicated incorrectly and/or inaccurately by Applicant.
2.6. Café reserves the right to turn down registrations.
2.7. Way of Registration:
Applicant must fill in the Registration Form available from the Website to register for the Conference. Applicant shall give the following information on the Registration Form: name, company name, address, name of the contact person, email address, invoicing address and shipping address. Applicant can send his application after having provided the requested data and paid online successfully. By sending his registration, Applicant accepts these T&Cs and all provisions of the Information Note on Data Processing available from the Website.
Café shall send a confirmation after the receipt of the registration, but in any case within 48 hours to the email address provided by Applicant during registration, which shall contain the registration data and a personal Conference entry ticket (or entry tickets if the registration is for several people). If Applicant finds any typos or errors in the data included in the confirmation, he may notify Café thereof in writing written at email@example.com email address.
3. Payment Terms:
Applicant shall pay the participation fee through the Website, using OTP Mobile Payment system. The participation fee shall be deemed paid when the success of online transaction is confirmed. This shall also be the date of Conference registration, too.
By clicking the Redirect button the Customer accepts Café Communications Kft ([1035 Budapest, Seregély u 3-5]) at http://cannualconference.wecan.net/ to provide the following personal data stored in its user database to OTP Mobile Ltd. (1093 Budapest, Közraktár utca 30-32.) Provided data: family name, given name, country, phone number, e-mail address. The purpose of data transmission: customer support for users, confirming transactions and fraud-monitoring for users defence.
4. Parties’ Rights and Duties
4.1. Applicant’s right and duties
4.1.1. Applicant may participate and take notes at the Conference, and may use materials released for his own purposes. Applicant shall not be entitled to transfer his rights hereunder to anybody else.
4.1.2. Applicant attending the Conference may be changed in email by on the day preceding the Conference. At the Conference, no voice or video recordings may be made and no pictures may be taken without Café’s permission. Applicant’s attendance may be suspended if this Clause is violated. In such case Café shall not reimburse the Conference participation fee.
4.2. Café’s Rights and Duties
4.2.1. If participation is cancelled, Café shall pay back the participation fee if te Applicant wrote an email about the cancellation not later than 15 days before the Conference. If participation is cancelled later, the Conference participation fee shall not be reimbursed.
4.2.2. Café may cancel the Conference if the number of applicants does not reach the minimum headcount or in case of force majeure. Café undertakes to notify applicants as soon as possible if the Conference is cancelled, and Café shall fully repay the participation fee within 8 days after the date of notification.
4.2.3. Although Café uses its best efforts to organize the Conference based on the program provided previously, but it reserves the right to change the program of the Conference without any prior notification, and so, among other things, Café may change the topic, the speakers or the sequence of presentations or may cancel some presentations.
4.2.4. Café declines its liability for any material or immaterial damage that may arise due to the changes specified in subclauses 4.2.2. and 4.2.3.
5. Data Protection
Café shall treat personal data received as confidential, and it may only use them for the purposes defined in the Information Note Data Processing available from the Website. Data protection rules applicable from time to time shall be kept in mind when processing data. See Café’s detailed Information Note on Data Processing at the Website.
6.1. All materials, publications, presentations and each of their components (hereinafter referred to as the Intellectual Property) are subject to copyright protection in favour of Café and each speaker. Café and the speakers reserve their right relating to the copying or publication of the Intellectual Properties through any method or technique.
6.2. Café and the speakers provide Applicant with a non-exclusive and non-transferable license to use the Intellectual Properties only for his own purposes, in accordance with their intended use. Applicant may not modify, reproduce or distribute the Intellectual Properties. Applicant shall not borrow, lend, rent or lease the Intellectual Properties, or he shall not be entitled to transfer his rights under these T&Cs to anyone else.
6.3. The use of the Intellectual Properties for commercial purposes through any online, digital or analogue information medium (e.g. CD, DVD, BLUE-RAY, HD-DVD, VHS, MINI-DV cassette etc.), and in particular the marketing, distribution or sale of such Intellectual Properties in any form shall be strictly prohibited. In addition, the modification or adaptation of any part of the Intellectual Properties or their integration into any other work, publication or website either electronically or in any other way is prohibited.
6.4. Café and the speakers may withdraw the license for use set forth in Clause 8 if Applicant breaches any conditions or stipulations of this Clause. In this case, Applicant shall destroy all copies and components of the Intellectual Properties in his property.
7. Complaint Management, Customer Service
7.1. Applicant may contact Café’s customer service at firstname.lastname@example.org email address if he has any questions or comments about the Website, the Conference announced on the Web page or his registrations submitted.
7.2. Applicant may lodge a complaint in connection with Café’s services by electronic means at email@example.com email address. Café shall assess the complaints received within 30 days and notify Applicant in writing of the outcome, using the contact details provided by Applicant.
7.3. If Applicant’s complaint is partially or completely turned down, or the above time limit for the assessment of the complaint expired without success, Applicant may turn to the following authorities and bodies:

If the dispute cannot be resolved or negotiated in any abovementioned way, the Party may bring the matter before court.
7.3. User may initiate to settle his complaint - in connection with a product or service purchased online - out-of-court in an online dispute settlement procedure. 8. Other Provisions
8.1. Café takes all reasonable measures to operate the Web page safely, but it does not undertake any further explicit or presumptive guarantee or warranty for the safety, up-to-dateness, correctness and virus-free, spyware or malware-free, uninterrupted operation of the Website. In connection with the use of the Website, Café recommends to Applicants to take all necessary precautionary measures: to use anti-virus and anti-spyware programs with up-to-date database, to install the security updates of the operating system. If Applicant registers for the Conference through the Website, it is presumed that Applicant knows the technical and mechanical burdens of the Internet and accepts possible errors inherent to the technology.
8.2. Café shall not be liable for any damage arising from the connection to the Website. Applicant shall protect his computer and all data thereon.
8.3. Café shall confirmation message to Applicant after receipt of the registration. Café shall not be liable for the any damage if: the application was not received due to any operational failure, or Applicant’s computer broke down due to any hardware or software error, or the Internet was disconnected.
8.4. Conference registration via the Website shall be governed in particular by Act CVIII of 2001 on certain aspects of electronic commerce and information society services (the E-commerce Act), Government decree no 45/2014 (ll.26.) on the detailed rules of agreements between consumers and undertakings and Act V of 2013 on the Civil Code.
8.5. These T&Cs shall be for an indefinite term and they shall be effective until amendment or withdrawal thereof. Café shall be entitled to amend these T&Cs unilaterally at any time. Any amendments shall enter into force upon publication at the Website.
8.6. Contracting Parties take all steps necessary in order to settle their disputes by way of negotiations. Should the settlement of a dispute by way of negotiations not be possible, Applicant may turn to the Arbitration Board attached to the Budapest Chamber of Commerce and Industry (registered seat: H-1016. Budapest, Krisztina krt. 99. III. em. 310.; mailing address: H-1253 Budapest, Pf.:10.) in order to settle its consumer claims out of court, simply and rapidly.
